Case dismissed in Naperville motorcycle crash

Charges have been dismissed in the case of a Naperville man accused of causing a traffic crash last month that sent a woman tumbling to the pavement from the motorcycle on which she was riding.

Andrew A. Hardin, 43, had been charged with failure to yield at a stop intersection. That followed the June 1 crash at Jefferson Avenue and Whispering Hills Drive, in the Will-O-Way area of Naperville’s west side.

The case against Hardin was dismissed when the man and woman who had been on the motorcycle failed to appear Wednesday to testify against him in the DuPage County Circuit Court’s Wheaton Field Court, according to records.

Hardin lives on the 1300 block of Sunnybrook Drive, not far from the scene of the crash. It occurred about 3:12 p.m. as he was driving his silver, 2012 Ford Focus south on Whispering Hills Drive.

A written police report stated Hardin stopped for a stop sign and then allegedly drove into the intersection without seeing a black, 2008 Yamaha XVS1300 motorcycle. It was traveling east on Jefferson Avenue with the right of way.

The driver, a 48-year-old Woodridge man, “attempted to avoid (the Focus), and lost control and dumped the bike,” according to the report. His passenger, a 50-year-old woman from Woodridge, fell to the pavement.

Paramedics took the woman to Edward Hospital in Naperville, where she underwent treatment for injuries to her head, face, hands and arms. Police, after ticketing Hardin, discovered a warrant had been issued for his arrest on a charge of theft in downstate White County.

Hardin in February 2002 lost his wife and the couple’s 7-year-old son and 4-year-old daughter in a traffic crash near downstate Carmi. Hardin’s wife and the children were traveling in their vehicle when it was struck nearly head-on by a tractor-trailer.

Another Hardin daughter, who was an infant at the time, survived the crash, as did the tractor-trailer driver.

The status of Hardin’s White County theft case was not immediately clear Friday.
